Asset Protection and Business Advice

The LegalSense NQ team gathered for a group portrait at the office

Asset protection starts with understanding where your business and personal risks sit. LegalSense NQ advises on legal structures and arrangements that help clients make informed decisions about ownership, control and exposure to risk.

This is not about a single document or a guarantee that assets can never be affected by a claim. The appropriate approach depends on your business, existing obligations, family circumstances and future plans.

Understanding your current position

A useful first step is to map how the business operates and how key assets are owned. We can discuss questions such as:

  • Who owns the business, premises and other significant assets?
  • Which people or entities sign contracts, borrow money or give guarantees?
  • What agreements exist between business partners, shareholders or family members?
  • How do company and trust arrangements fit the intended business plan?
  • What happens to ownership and control if someone retires, loses capacity or dies?

Practical legal planning

Our advice can consider company and trust structures, partnership and shareholder agreements, business succession arrangements and the relationship between those documents and your personal estate plan. We work with your accountant and financial adviser where appropriate, so legal choices are considered alongside tax, finance and insurance issues.

The aim is to identify the relevant risks and make deliberate decisions about them. Clear documents and an understanding of each person's role are important parts of that process.

Know the limits of asset protection

A company or trust does not automatically remove personal liability. Guarantees, legal duties and the circumstances of a transaction can still matter. Transferring an asset after financial difficulties arise may create further problems, and some transactions can be challenged or recovered in bankruptcy.

Do not move assets in an attempt to avoid creditors. Seek advice about your particular position. The Australian Financial Security Authority explains the treatment of property in bankruptcy.

When to review your arrangements

A review is worth considering before starting a business, acquiring a significant asset, accepting a new business partner or giving a guarantee. It may also be useful when ownership changes, the business grows or your retirement and succession plans become clearer.

Bring a summary of assets and liabilities, company and trust documents, existing business agreements, finance documents and relevant guarantees. Let us know about any current dispute, demand or financial concern at the outset.

Common questions

Is there a structure that protects every asset?

No. Each arrangement has limits, obligations and consequences. Advice should be based on your actual circumstances rather than a promise of complete protection.

Can I simply transfer an asset to a family member?

Do not assume that a transfer is effective or appropriate. Existing debts, creditor rights, tax, duty and other legal issues need to be considered before anything is signed or transferred.
